Privacy policy
This policy explains what personal information I collect through this website and when I help you with finance, what I do with it, who I share it with, and how you can access it, correct it or complain.

Who I am
I'm Delcy Pandya, a Mortgage & Finance Broker based in Sydney, NSW. I am a Credit Representative (Credit Representative Number 578883) of Australian Finance Group Ltd ACN 066 385 822, Australian Credit Licence 389087, and I trade as Mortgage Advice Bureau through T And D Operations Pty Ltd ACN 674 051 908 (Credit Representative Number 578882).
In this policy, "I", "me" and "my" mean me and T And D Operations Pty Ltd. I handle personal information in line with the Privacy Act 1988 (Cth), the Australian Privacy Principles and, where credit information is involved, Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code.
Mortgage Advice Bureau and Australian Finance Group Ltd have their own privacy policies, which also apply when they handle your information. You can read Mortgage Advice Bureau's privacy policy on their website.
What I collect
Through the enquiry form on this website
When you send an enquiry, the form asks for:
- your first and last name, email address and mobile number;
- the type of loan you're interested in and the amount you'd like to borrow;
- details about the loan, such as its purpose, the kind of asset, and whether you've already found one;
- your living situation (for example renting, or a home owner with or without a mortgage) and your state;
- if you have an ABN, how long you've held it and how long you've been registered for GST;
- how you would describe your own credit history; and
- your total yearly income.
Your answers about your credit history are your own description. Sending the form does not involve a credit check and does not affect your credit score.
To keep spam and automated attacks out, the form uses Cloudflare Turnstile, which checks short-lived signals from your browser (such as how the page was loaded) to tell people from bots. It does not ask you to do anything and does not set cookies.
When I help you with finance
If we go ahead, I'll need more information to find suitable options and prepare an application. Depending on the loan, this can include your date of birth, address history, identification documents, employment and income details, bank statements, assets and liabilities, details of your dependants, business and tax information, and information about your credit history. I'll tell you what a particular lender needs and why.
I usually collect information directly from you. With your consent, I may also collect it from other people, such as your accountant, a co-applicant, your employer, a lender, a valuer or a credit reporting body.
You don't have to give me your information. If you don't, I may not be able to help you, or a lender may not be able to assess an application. You can make a general enquiry without giving your name by phoning me, but I will need to identify you before I can help with an application.
Why I collect it and how I use it
I collect and use your personal information to:
- reply to your enquiry and talk with you about your finance needs;
- understand your objectives and financial situation so I can identify suitable finance options;
- prepare, lodge and follow up applications with lenders, and manage the process through to settlement;
- verify your identity and meet my legal obligations, including responsible lending obligations under the National Consumer Credit Protection Act 2009 (Cth) and anti-money laundering laws;
- keep records my licensee and I are required to keep, and handle complaints; and
- let you know about other finance options that may suit you, if you're happy to hear from me (see Marketing).
I don't sell your personal information, and I don't use it for any purpose you wouldn't reasonably expect.
Who I share it with
To do the job you've asked me to do, I may share your personal information with:
- Mortgage Advice Bureau and Australian Finance Group Ltd, my licensee, for supervision, compliance, record keeping and complaints handling;
- lenders you choose to apply to, and their mortgage insurers, valuers and service providers;
- aggregators and the software platforms brokers use to compare products and lodge applications;
- other people involved in your application with your consent, such as a co-applicant, guarantor, accountant, solicitor, conveyancer or real estate agent;
- service providers who help me run my business, such as IT, email and document storage providers; and
- government bodies and regulators, where the law requires or allows it.
How the enquiry form reaches me
This website is hosted by Cloudflare, Inc. When you send an enquiry, your answers pass through Cloudflare's servers, which turn them into an email and send it through Cloudflare's email service to my work inbox at hi@delcy.finance, provided through Mortgage Advice Bureau. The website itself does not store your enquiry in a database. Cloudflare's handling of the information is covered by the Cloudflare privacy policy, and Turnstile by the Turnstile privacy addendum.
Overseas disclosure
Cloudflare runs a global network, so when you use this website your information may be processed in data centres outside Australia, including in the United States.
Lenders, aggregators, my licensee and our service providers may also store or process information overseas. Mortgage Advice Bureau's privacy policy says this may include the United States, Canada, Malaysia, India, Ireland, the United Kingdom and the Philippines. Where information is disclosed overseas, reasonable steps are taken so that the recipient handles it in a way that is consistent with the Australian Privacy Principles.
Credit information and credit reporting
Credit information is information about your credit history, such as the credit you've applied for, your repayment history, defaults and any court judgments or insolvency. It is given extra protection under Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code.
- Lenders you apply to will usually obtain a credit report about you from a credit reporting body, such as Equifax, Experian or illion. They do this when you apply, not when you send an enquiry through this website.
- With your consent, I may collect credit information about you, or information a lender derives from it, and pass it between you and the lenders you apply to so your application can be assessed.
- I only use and disclose credit information for the purposes the law allows, such as assessing and arranging your application.
- Each credit reporting body has its own credit reporting policy, which explains how it handles your information, and you can ask it not to use your information for direct marketing or to put a ban on your file if you think you have been, or are likely to be, a victim of fraud.
You can ask me for access to credit information I hold about you, or ask me to correct it, as described below. If I can't correct it myself, I'll help you contact the lender or credit reporting body that can.
Storage and security
I take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, change or disclosure. This includes password-protected and access-controlled systems, encrypted connections (this website only works over HTTPS), and limiting access to the people who need it to help you.
If there is a data breach that is likely to cause you serious harm, I (with my licensee) will notify you and the Office of the Australian Information Commissioner as the Notifiable Data Breaches scheme requires.
How long I keep it
I keep your personal information only for as long as I need it for the purposes above, or for as long as the law requires. Credit and anti-money laundering laws require some records to be kept for a number of years after our dealings end. When I no longer need information and the law doesn't require me to keep it, I take reasonable steps to destroy it or de-identify it. If an enquiry doesn't go ahead, the same applies to the enquiry email.
Access and correction
You can ask for access to the personal information I hold about you, and ask me to correct anything that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact me by phone on 0449 637 558 or by email at hi@delcy.finance.
- I'll need to confirm your identity first.
- I'll respond within a reasonable time, and usually within 30 days.
- There's no charge to ask. If giving you access takes significant work, I may ask for a reasonable fee first, and I'll tell you before any cost is incurred.
- If I can't give you access or make a correction, I'll tell you why in writing and how you can complain.
Marketing
I may occasionally let you know about finance options or reviews that could suit you, but only where you've agreed or would reasonably expect to hear from me. Every marketing email includes a way to unsubscribe, and you can ask me to stop at any time by phone or email. There is no charge, and opting out won't affect any application I'm helping you with.
Cookies and analytics
This website does not use cookies, analytics, advertising pixels or tracking scripts, so there is no cookie banner.
If you use the on-page switch to turn motion off or on, your browser remembers that choice in its own local storage. It stays on your device, is not sent to me, and you can clear it at any time in your browser settings. If I ever add analytics, I'll update this policy first.
Privacy complaints
If you think I've mishandled your personal information, please tell me first so I can put it right. Contact me on 0449 637 558 or at hi@delcy.finance. I'll acknowledge your complaint, aim to do so within one business day, and give you a response within 30 days. My complaints page explains the process in full.
